How RFEs work on the I-129F
A Request for Evidence (RFE) is a USCIS notice asking for specific additional documents needed to adjudicate your petition. You have 87 days from the date on the RFE notice to respond. Failure to respond by the deadline results in denial of the petition with no refund of the filing fee.
The most common I-129F RFEs ask for additional evidence of: (1) a bona-fide intent to marry, (2) the required in-person meeting within the 2 years preceding I-129F filing, (3) the petitioner's U.S. citizenship status, (4) termination of prior marriages, and (5) the beneficiary's identity or eligibility.
Critical rules for RFE responses
- Respond in ONE complete package. USCIS will adjudicate based on what is in front of them on the date the response is reviewed — you cannot supplement after submission.
- Mail the response to the address printed at the TOP-RIGHT of the RFE notice, not the original filing address. The notice address is the service center actually adjudicating your case.
- Use certified mail with return receipt or a tracked courier (FedEx/UPS). Keep proof of delivery in case of a tracking dispute.
- Address each item in the same order as the RFE notice. If USCIS asked for items 1, 2, and 3, your response should also be organized as items 1, 2, and 3.
- Quote the exact language from the RFE before each response section. This shows the officer you understood the request and makes review faster.
- Do NOT include unrelated supplemental evidence. If USCIS asked for in-person meeting proof, do not include a 50-page WhatsApp printout. Stay on-topic.
What NOT to do
- Do not request an extension — USCIS does not grant RFE extensions.
- Do not file a new I-129F instead of responding. That creates two pending cases and confuses the record.
- Do not argue with the officer or accuse them of bias. Provide the requested evidence professionally and let the documents speak.
- Do not include items the RFE didn't request unless they are essential to clarifying a misunderstanding the officer is operating under.
After you submit
USCIS typically issues a decision within 60-90 days of receiving the RFE response. The case will return to "Case Was Updated to Show Fingerprints Were Taken" or similar status before final adjudication. If approved, the case moves to the National Visa Center (NVC) for consular processing. If denied, you have 30 days to file a Motion to Reopen / Reconsider (Form I-290B) or to refile.
Frequently asked questions
How many days do I have to respond to an I-129F RFE?
USCIS gives you 87 days from the date on the RFE notice (sometimes phrased as "84 days plus 3 days for mailing"). The deadline is strict — late responses result in denial. The exact response-due date is printed on the RFE notice itself; use that date as the deadline rather than counting from the notice date.
Where do I mail the RFE response?
Mail the response to the address printed at the TOP of the RFE notice, NOT to the address where you originally filed the I-129F. The notice address routes the response directly to the officer handling your case. Most RFE notices include a printed barcoded cover sheet — include that barcoded sheet on top of your response so USCIS's scanning system links the response to the file.
Should I include the original I-129F petition again with my RFE response?
No. Do not resubmit the original petition or the documents you originally filed. USCIS already has those. Include only the new documents responding to the RFE items. The exception is if USCIS specifically asks for a refiled form or for re-signed pages — follow what the RFE notice says.
What if I can't produce one of the documents USCIS asked for?
Explain why in the response, and provide the closest acceptable alternative. For example, if USCIS asks for a marriage certificate that does not yet exist (because the K-1 marriage has not happened), include a signed statement explaining that the K-1 process is by definition pre-marriage. For lost or destroyed documents, include a notarized declaration of unavailability and any secondary evidence (e.g., a delayed birth certificate from the issuing jurisdiction).
Will I get a second RFE if my response is incomplete?
Usually not. The first RFE is typically the only chance to add evidence — a second RFE on the same item is rare. If the response does not satisfy the officer, the more common outcome is a Notice of Intent to Deny (NOID) or an outright denial. This is why it's important to address every item completely the first time.
